The CA "pure PAGA" case may be maintained even if there are individual non-wage claims. It may be that the arbitration agreement would result in those FEHA or WTVPP claims to be the subject of a separate, parallel demand for arbitration by the employee in his non-representative, individual capacity for "personal injuries." He would file the PAGA case not as an individual, but as a Private Attorney General. In that situation, the arbitration case should not stay the PAGA action as there are no common wage issues that could operate as collateral estoppel to the PAGA action. Essentially, there are two separate party-Plaintiffs and two separate actions with no overlapping issues.

it is delightful to see a court "do the right thing" instead of coddling lazy lawyers who appear in court unprepared, then ask for their fee. most judges don't care - they allow motions simply because the moving party is an attorney. Kudos to Judge Telesca!

We purchased a pool signed paperwork in April 2017 they finally delivered in May 2017 and poked holes in the liner during installation pipes were leaking and also the ladder has a crack in it. When we asked Blue World Pools to repair they sent a gentleman to come fix it however he only tightened the pipes that were leaking told us the holes in the liner "won't hurt anything" and ordered a new ladder. We received parts to repair a ladder and still have not had the gentleman contact us to replace the parts. We were under impression we were getting a new ladder. We are upset that we purchased a pool and have had no resolution to the issues. Yet when we had an issue making payment due to personal unforeseen issues we received harassing phone calls and threats that they will take our home. How can they expect me to pay for a pool that has holes and a broken ladder? They want arbitration but won't resolve issues when presented to the company without legal enforcement.

Hello, You gave the facts of this case wrong. The judge never said no substantial similarities, he said they were passing. If you are going into the case to teach from my case you gave to get all the facts straight. Tyler Perry's team threatened and scared my attorney from defending himself because he worked with and for the other side, that email and those facts is in the file 1:13-cv-0165-whp to include the facts that the case transferred from PA already defaulted by Tyler Perry, they signed a summons and waiver and defaulted, they signed an order and stipulation with the judge and defaulted and was given another opportunity and defaulted and my attorney was not allowed pro hac vice the morning,of the hearing which wasnt supposed to be a hearing for summary judgement but pre trial hearing so he was blind sided and told them he wasn't prepared. This is my case and there are too many facts ommited, on appeal I discovered the defaults and it was too late they cannot consider new eviden
