However his grandson, Jim Alka was a disturbed child and molested me and was caught in a closet doing so when I was about 5 years old and he was a teenager on drugs. Marvin's grandson, then removed him from the home we were living at with him on College Drive. We continued to live with him for many years. Just before my freshman year of high school, Marvin's grandson moved back into the home we lived at on Skiles Dr. Mt. Carmel, IL. At that time he was still using drugs and in his twenties. He came into my room one night naked and woke me up down in my face. I tried to hide from him and he left. I began sleeping in my brothers room right across the hall from Marvin and my mothers room ( Marcia). I was afraid of Jim. Parents found out then divorce

This is bad law. It separates Wisconsin courts from the rest of the nation. Statutes of repose granting immunity from suit for architects is quite common. In fact, there was one case in our Torts casebook dealing with a statute of repose in negligent design cases, and we spent a great deal of class time on the public policy considerations of why architects and builders would be granted immunity from suit. Such statutes have repeatedly passed Constitutional muster. Where the court gets it wrong is in holding that accrual of injury starts the clock. Were the building 400 years old, they could probably see the folly in that. There has to be some kind of reasonable limit. The defendant's negligence could not have occurred in close enough proximity to establish causation after such a passage of time. Statutes of repose typically disregard accrual of injury. That the Wisconsin legislature styled this section inappropriately is insufficient to affect the nature of the statute.

I kinda-sorta met Mr. Gardner today as he walked the block holding a flagpole flying the American Flag upside down to draw attention to our constitutional responsibility to guard our country against judicial injustice. He states this case cost him over a half a million dollars and almost ruined his families lives which is why he moved to Conway Arkansas. He provided two separate handouts, one for voters and the other, a three page constitutional lesson, describing flag protocol and constitutional responsibility. He handed me this from a clear folder attached to his belt as he briefly stopped during the third lap of the block that I had witnessed. He strode briskly and impressed me with his ability to hold the flagpole with a rigid uprightness fueled by, I am sure, a clear conscience and sense of indignation. Judging is best done by the courts, I wish he and his family well.
