I was the one who originally detected the embezzlement from my aunts estate. I am curious to know what the sentence was for the crime. I might add that Mr McHale still took a $75,000 fee out of my aunts estate, even though he was complicit in allowing the embezzlement to occur. I notified the W.Va. Bar of this, but they didn't even bother to answer my letter.

The special master "DID NOT" rule the act involved moral turpitude but just the opposite. The Supreme Court miss-read his decision and upon a motion to reconsider, the Chief Justice voted yes. Did seven judges all read a four page opinion and all miss-read it the same way. Probably not. A clerk probably briefed the ruling from the Special Master, mis-read the opinion, and the judges took his/her word for the brief and voted the way they did. They then filed a decision they knew was not true. Get the file for yourself and see. Was Due Process served when the court did not even read the filed opinion? We think not but what can one do.

He "GRANTED" the petitioner's motion for a stay and abeyance order, as shown throughout the decision and expressly stated in the third to the last paragraph, which states, "IT IS THEREFORE ORDERED that petitioner's motion for an order staying and holding these proceedings in abeyance (#45) is GRANTED."

I purchased a 2002 Chevrolet Trail Blazer back in January and here it is April and the Transmission is gone I went for a oil change and when they looked at all my fluid upon inspection the transmission fluid was over by 2 quarts mind you I haven't put any transmission fluid in it since I purchased it and when I called the dealership I purchased it from they said it's nothing they can do if I had known there was a bad transmission I wouldn't purchased it

No mention of the facts that: 1) Schram and Nickerson knew each other and played on the same little league team for years Mosholu Little League 2) That Nickerson supplemented his work with dealing drugs on Webster Avenue at Bars 3) That Schram knew where he lived because he had visited this location during the day for such previous purchases. 4) They both attended Mt St Michael Academy High School for at least 1 year together, so knew each other from ages 10 to 20. Makes you wonder why all facts are not in evidence.
