Mrs. Root assigned me to write the brief seeking a hearing before the CA Supreme Ct which resulted in a hearing being granted on Jan. 8, 1963. I agree. This man did not deserve to spend ten years on a life sentence when the only overwhelming evidence is the alleged victim testimony and a nurse’s testimony that sexual Intercourse happened. The victim testimony is as equally eligible to be true or false as the defendants. He says it was consensual, she says it wasn’t. This man had no prior criminal history and is clearly not a violent person. To be issued a life sentence is absurd. The reports say that both parties were intoxicated, they knew one another and were acquaintances, he was clearly invited to her home and didn’t show up uninvited. What happened after that is a grey area with no hard evidence on either side of whether the act was consensual or non-consensual. A life sentence to be issued under those circumstances is absurd and shows clear flaws in the justice system. As a woman, I do not agree anyone should be able to put away a man behind for ten years without some serious hard evidence that this was in fact a rape.

I also received a letter from Social Security advising me I was included in this class action law suit. So I got my papers from my settlement back in 2010. I received approxiamately 3,000 dollars less than the amount on this letter. I never knowing joined this lawsuit. I also got another letter stating how much lawyer fees they gave to this company. Since my original lawyer received $5600 and the limit is $6000 this lawyer can only recieve $400 from me as lawyer fee. So if my calculations are correct I should receive a settlement of $2804. I plan to check in with this firm and let you all know what I find out.
