I personally read the transcript on this cas. The appellate court is sadly incorrect in their review of the entire record. The transcript jumps all over the place and it is difficult to follow, but nonetheless it does reveal that permission given to the Sheriffs was after they had already performed an exploratory searched, located Folb over 100 yards beyond the home (out of sight), searched for a VIN and arrested Folb. He was off to jail when they encountered Ms. Everhart; and then she gave them permission to venture on further beyond where they incurred Folb. At that time she requested that Folb not be on the property. This is a classic "railroad" the defendant with his incompetent public defender and an appellate attorney who is of the same mindset. There is no justice for people who cannot afford to match the deep pockets of the District Attorneys Office and the injustice that forces defendants to succumb to how the system doles out justice, like a McDonalds Happy Meal. Injustice.

The Bank's defense counsel has continuously waited until the due date to respond, mostly to our discovery requests, then files an open ended motion for extension of time usually without conferring with opposing counsel beforehand. The act of putting a piece of paper into the file should NOT automatically negate a strictly construed deadline. Dilatory stalling tactics are sanctionable, but judges rarely if ever impose sanctions. The system is broken.
