PER CURIAM.
This case arises from the arrest of Lawrence Merenda. Merenda brought an action under 42 U.S.C. § 1983 alleging that the arresting officer, Justin Tabor, violated his First, Fourth, and Eighth Amendment rights in making the arrest. Tabor moved for summary judgment on the basis of qualified immunity. After hearing oral argument, the district court granted Tabor qualified immunity as to the Eighth Amendment claim
