Defendant was indicted for the murder of Robert J. Flynn. The jury convicted him of murder in the first degree and imposed the sentence of death. The Commonwealth contended that Flynn's death occurred as the result of arson and that his death was a felony murder in the commission of which felony defendant was one of the principals.
