WOLLMAN, Circuit Judge.

Bruce Martin Construction, Inc. (Bruce Martin), appeals two district court1 orders, one dismissing its negligent misrepresentation claim against CTB, Inc., on the pleadings, the other granting summary judgment to CTB on Bruce Martin's breach of warranty claim. We affirm.
