These six cases come before us because of controversy about the Fair Labor Standards Act ("the FLSA" or "the Act"). Defendants disputed their obligation to pay Plaintiffs the minimum wage or overtime under the Act. All of the district courts dismissed the cases on summary judgment or judgment as a matter of law because the courts concluded that the FLSA did not apply.
