Darrell Lawshe was employed as a foreman for Fluor Enterprises, Inc., d/b/a Fluor Signature Services ("Fluor"). On November 4, 2006, Lawshe and his crew were loading a piece of metal shaped like a "T" ("the T-bar") onto the roof rack on a pickup truck. As the men were lifting one end of the T-bar from the ground, Lawshe became concerned that the other end of the T-bar might hit the window of the cab of the pickup truck.
