On August 26, 2009, we issued an opinion affirming the trial court's judgment. See Mr. W Fireworks, Inc. v. Ozuna, No. 04-08-00820-CV, 2009 WL 2616507 (Tex. App.-San Antonio Aug. 26, 2009). Appellant Mr. W Fireworks, Inc. then filed a motion for rehearing. We deny the motion for rehearing; however, to correct a factual misstatement and clarify our opinion, we withdraw our prior opinion and judgment...
