[¶ 1] Faustina Fogarty appeals from a judgment entered in the Aroostook County Probate Court (Dunleavy, J.) denying her petition for a declaratory judgment that she was the beneficiary of an oral trust created by her brother, the late George Fournier. Fogarty contends that the undisputed evidence compelled a finding that Fournier created an oral trust for her benefit. We agree and vacate the judgment...
