Defendant stands convicted of murder in the second degree in violation of Penal Law § 125.25 (2) for the January 1988 death of his seven-week-old infant son under an indictment charging him with causing the infant's death "by means of shaking him and inflicting trauma to his head, under circumstances evincing a depraved indifference to human life demonstrated by the multiple injuries to the head, eyes, brain and spine."
