LYONS, Justice.

Wayne Holleman Travis was convicted of capital murder for the death of Clarene Haskew; he was convicted under § 135-40(a)(4), Ala.Code 1975—murder committed during the commission of a burglary in the first degree. By a vote of 11 to 1, the jury recommended that Travis be sentenced to death. The trial court followed the jury's recommendation and sentenced Travis to death by electrocution.
