Petitioner Joe Barrios moves under 28 U.S.C. § 2255 to have his sentence vacated and reimposed so that he may file a new notice of appeal. Mr. Barrios claims he received inadequate assistance of counsel because his attorney, after filing a notice of appeal on Mr. Barrios' behalf, never filed any briefs, despite Mr. Barrios' desire to pursue his appeal.
