MEYERS, J., delivered the opinion of the Court, in which KELLER, PRICE, HOLLAND, WOMACK, and JOHNSON, JJ., joined.

Appellant was convicted of attempted murder1 and sentenced to twenty years in prison. On appeal, Appellant argued he received ineffective assistance of counsel because Appellant's testimony raised the defense of necessity and counsel failed to request a jury instruction.
