On August 31, 1994, petitioners Clay Gaspard and Kern Pittman ("petitioners"), filed a suit for damages in civil district court for the Parish of Orleans. Petitioners alleged that they were exposed to toxic substances while employed by defendant Arc Mechanical Contractors, Inc. ("Arc"), while working at Robert R.
