AMIDEI, Justice.

A jury convicted appellant of misdemeanor assault. The trial court assessed his punishment at thirty days in the county jail and a $300.00 fine probated for two years. On appeal to this court, appellant contended (1) the trial court abused its discretion in having testimony read to the jury and (2) the trial court erred in denying appellant's motion for mistrial.
