The plaintiff below, George Kavorkian, sued his employer, CSX Transportation, Inc., alleging that CSX was liable under § 2 of the Federal Safety Appliance Act (FSAA), 49 U.S.C.A. § 20302(a)(1)(A) (1997), for damages that he incurred after injuring his back while working for CSX.
