The state appeals a pretrial order allowing defendant's motion to suppress the audio portion of a video tape recording made during defendant's arrest for driving under the influence of intoxicants. The trial court ruled:

"That the officer failed to specifically inform the Defendant that the Defendant's conversation was being obtained by electronic recording, and that in the totality of the circumstances the Defendant was unaware that...
