Defendant was convicted in the Town of Bernalillo municipal court of speeding and driving while intoxicated. He appealed the judgment to the Sandoval County District Court. Pursuant to NMSA 1978, Section 39-3-1 (Repl.Pamp.1991), such appeals are "tried anew ... on their merits, as if no trial had been had below[.]" See SCRA 1986, 8-703(I) (Repl.1990).
