Tennessee Farmers Mutual Insurance Company filed suit for declaratory judgment that the policy of insurance issued to Roland Witt provided no coverage for collision damage sustained to a rental automobile operated by Witt while under the influence of alcohol. On cross motions for summary judgment, the trial court granted Witt judgment declaring there was coverage; the Court of Appeals reversed, holding there was no coverage...
