The appellant, Robert Lee Tarver, Jr., was found guilty of murder made capital because the murder was committed during the course of a robbery. Section 13A-5-40(a)(2), Code of Alabama 1975. The jury recommended that the appellant be sentenced to life without parole. The trial court overrode the jury's recommendation and sentenced the appellant to death by electrocution...
