On September 25, 1987, plaintiff, Kalan Rodgers, Sr., filed suit against defendant, St. Mary's Hospital, in the circuit court of Macon County. The complaint alleges that the hospital failed to preserve for litigation all X rays taken of his wife, Brenda Rodgers, who had been a patient at the hospital for several days before she died there.
