The defendant, Dennis Foskey, was convicted by a jury in the circuit court of Cook County of possession of a controlled substance (heroin) with intent to deliver (Ill. Rev. Stat. 1985, ch. 56 1/2, par. 1401(a)(1)) and sentenced to 12 years' imprisonment. The defendant, along with two codefendants, had also been indicted for conspiracy...
