This is an appeal from an order of the United States District Court for the Northern District of New York, Foley, J., dated June 24, 1988, which denied the plaintiff's motion for summary judgment, granted defendants' cross-motion for summary judgment and dismissed the plaintiff's § 1983 complaint.
