This is an appeal from a summary judgment in a class action challenging the procedure followed in a cash distribution from a stock ownership plan. Judgment was rendered and entered solely on the issue of breach of fiduciary and statutory duties in the administration of an Employee Stock Ownership Plan ("ESOP"), on the grounds that plan participants did not receive the full amount to which they were entitled.
