The defendant, George B. Gilbert, was convicted of driving under the influence, second offense, by a jury of his peers. The trial court sentenced the defendant to pay a fine of $1,500, the amount recommended by the jury, and confinement in the Sumner County Jail for eleven months and twenty-nine days.
