This is an appeal of a civil action wherein R.B. Enterprises, Inc., unsuccessfully challenged the constitutionality of K.S.A. 1986 Supp. 8-116a(b). The defendant State of Kansas cross-appeals the district court's denial of its motion for judgment of involuntary dismissal and its motion for the imposition of stenographic costs on R.B. pursuant to K.S.A. 60-2002(a) and 60-2003(5).
