This action is before the court on the motion of defendant New Jersey Transit Rail Operations, Inc., ("NJTRO") to dismiss on the ground that the Special Court lacks subject matter jurisdiction over the complaint. Following oral argument on this matter, the defendant unions filed a separate motion to dismiss. For the reasons stated below, NJTRO's motion is granted and the case dismissed.
