Defendant, David Rushing, Jr. was indicted by the St. Tammany Parish Grand Jury on April 21, 1983 for the first degree murder of Danny Archer, a violation of La.R.S. 14:30. A jury of twelve unanimously found the defendant guilty of the crime charged. Following the sentencing hearing, the jury recommended unanimously that the defendant be put to death, and the trial court sentenced him accordingly.
