ORRICK, District Judge.

This copyright case is based upon charges by plaintiff that defendant creators and producers of the movie "The Empire Strikes Back" ("ESB") copied some of his drawings for use in that film. Plaintiff possesses no originals of any of the work he contends was copied by defendants. In fact, plaintiff has been unable to produce any neutral third party who currently has in his or her possession an original or duplicate of the works...
