PER CURIAM.

In September 1979, the Hillsborough County Grand Jury returned four indictments against the defendant. The indictments alleged that on June 7, 1979, and on June 9, 1979, the defendant either attempted to obtain or obtained a controlled drug, percodan, by fraud in violation of RSA 318-B:20 (Supp. 1979). Prior to trial, one of the indictments was nolle prossed.
