The plaintiff brought this action in two counts against the defendant city for injuries he allegedly sustained as the result of a fall on ice. The incident occurred on February 6, 1976, in the traveled portion of Cottage Street, a public highway fronting the plaintiff's residence, while the plaintiff was retrieving his empty trash barrels after a trash collection by the defendant.
