BIFFERATO, Judge.

Plaintiffs, Dorothy and Richard Lacy, brought this medical malpractice claim for defendant's reckless and negligent disregard for Dorothy Lacy's health and safety regarding a malignant, inverted mass in her right breast. Following defendant's demand for the convening of a Malpractice Review Panel, pursuant to 18 Del.C. § 6802, plaintiffs moved to strike that demand on the grounds that this procedure, as established by 18 Del.C.
