GOLDBERG, Circuit Judge:
Under the Age Discrimination in Employment Act of 1967 [ADEA], 29 U.S.C.A. §§ 621-34 (West 1975) (amended 1978), an aggrieved employee may commence suit against his employer for age discrimination only upon filing a notice of intent to sue with the Secretary of Labor within 180 days after the occurrence of the alleged unlawful act.
