COTTER, C. J.

The plaintiff appeals from a judgment dismissing his petition for a writ of habeas corpus. The plaintiff, Earl J. Staton, was convicted of robbery in the third degree after a trial to a jury and was sentenced to a term of imprisonment of not less than two years nor more than four years. Following the imposition of the sentence, he broke from the courtroom and was subdued by several policemen.
