By complaint filed August 23, 1974, plaintiff commenced this action against Pens Unlimited Co. and its president and sole stockholder Herbert W. Forde.1 Plaintiff grounded his complaint in four separate counts: breach of contract (count I), promissory estoppel (count II), misrepresentation (count III) and wilful misrepresentation (count IV).
