This diversity case arose out of the injuries suffered by 18-year old Thomas Hooks when he dove from the three-meter diving board at the Sheraton Park Hotel in Washington, D.C., in June 1971. The pool was equipped with a high performance aluminum "Duraflex" board that propelled Hooks, who was not an experienced diver, into shallow water where he struck his head on the bottom.
