This appeal concerns denial of attorney's fees to the prevailing defendant in a tort action which arose out of an automobile collision. David Miller, defendant and appellant, obtained a jury verdict in his favor in this suit brought by Maurine and Richard McManus. He moved for an award of attorney's fees pursuant to Civil Rule 82.
