Defendants move for summary judgment in this action brought under sections 50 and 51 of the Civil Rights Law of New York. Plaintiff seeks damages for the unauthorized use of his name and photograph in an article written by his former wife, Betty Friedan, and published in New York Magazine, both of whom are named as defendants with respect to that publication.
