SUMMERS, Justice.

The District Attorney of East Baton Rouge Parish charged that defendant, Gary M. Marmillion, "on or about the second (2nd) day of July, 1974, at and in the Parish. . . aforesaid, feloniously violated La. R.S. 14:60, in that he committed aggravated burglary of a structure belonging to Tiger Plaza Apartments. . . ." Defendant pleaded not guilty and not guilty by reason of insanity. After trial by jury, defendant was found guilty of aggravated burglary...
