OPINION

DUNCAN, Judge.

The defendant, Roy Hawkins, was tried in the Monroe County Criminal Court on an indictment charging first degree murder. He was found guilty of second degree murder and received a penitentiary sentence of twelve (12) years. The defendant's cousin, Hobert Lee Hawkins, was a co-defendant in the case, but was acquitted by the jury. The defendant has duly perfected his appeal...
