On an information charging him with selling LSD in violation of Health and Safety Code section 11912 (now § 11379) and alleging a prior conviction for a violation of the same section, defendant pled not guilty and denied the prior.1 Following a jury trial, he was found guilty as charged and the allegation of the prior was found to be true.
