KELLEY, Justice.

Defendant appeals from an order of the District Court of Pueblo County dismissing his motion for Postconviction Review, pursuant to 1971 Perm.Supp., C.R.S.1963, 40-1-510(1) (f). We affirm.

The record shows that the defendant was convicted by a jury of statutory rape on April 16, 1970. On May 18, 1970, the defendant was sentenced to the Colorado State Penitentiary. The judgment of conviction became final on September 13, 1972, when rehearing...
