The defendant, Melvin Siberon, was indicted by a grand jury on a charge of murder in the first degree, tried by a jury and found guilty with a recommendation of a sentence of life imprisonment. The court denied his motion to set aside the verdict as contrary to law and against the evidence and he appealed to this court.
