GILBERT, J., delivered the opinion of the Court.

Robert T. Mulligan, appellant, makes his third appearance in this Court as a result of his being convicted thrice by a jury in the Criminal Court of Baltimore for the second degree murder of his child, Mary Lynn Mulligan, age eight months. We reversed the appellant's first conviction, Mulligan v. State, 6 Md.App. 600, 252 A.2d 476 (1969)...
