KELLEY, Justice.

This is an appeal from an order of the district court discharging Buckmon's petition for writ of habeas corpus. We find no error and affirm.

Buckmon was indicted by a grand jury in Tennessee, charged with assault with intent to commit first-degree murder and malicious stabbing.
