This case arises out of a fire which occurred at the residence of Joseph M. Turner, Poe Road, Bethesda, Maryland, on February 23, 1965. At the time of the fire Mr. Turner carried fire insurance on his home with The Home Insurance Company (appellant) under a policy which granted the right of subrogation to the insurer against third party tortfeasors whose wrongful acts might prove to have been the cause of any loss under...
