The appellant was the plaintiff in the trial court. He sued for damages resulting from the claimed negligence of the defendant. He alleged that while the car he was occupying was stationary waiting to make a left turn across the center line of a highway in the nighttime, a car driven by the defendant collided with the rear of his car.
